Terms of Service

1. Agreement
By registering an account or using any service provided by CM Cloud Hosting (operated by Cirronyx Sarl, hereinafter "we", "us", or "CM Cloud"), you agree to these Terms of Service. If you do not agree, do not use the services.
2. Services
We provide web hosting, VPS hosting, domain registration, email hosting, PocketBase hosting, and related services as described on our website. Service specifications (storage, bandwidth, compute) are as listed at the time of purchase. We reserve the right to change or discontinue any service with 30 days' notice.
3. Eligibility
You must be at least 18 years old to create an account. By using our services, you confirm you have the legal authority to enter into this agreement.
4. Account
- You are responsible for maintaining the confidentiality of your password and account.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorised access or breach.
- We may suspend or terminate accounts that violate these Terms.
5. Acceptable use
You agree not to use our services to:
- Host, distribute, or transmit illegal content.
- Send unsolicited bulk email (spam).
- Run denial-of-service attacks or network scanning tools.
- Infringe any intellectual property rights.
- Mine cryptocurrency without our explicit written consent.
- Resell services without prior written permission.
6. Billing and payment
- Services are billed in advance on a monthly or annual basis.
- Accepted payment methods: credit/debit card (Stripe), PayPal, and CamPay mobile money.
- Invoices are due immediately upon issuance.
- Services may be suspended after 7 days of non-payment.
- Services may be terminated and data deleted after 14 days of non-payment.
- Prices are listed in USD and are exclusive of applicable taxes.
7. Refunds
New customers may request a full refund within 7 days of the first payment on any shared hosting or VPS plan. Domain registrations, renewals, and SSL certificates are non-refundable. Refunds for promotional or discounted orders are issued at our discretion.
8. Uptime and SLA
We target 99.9% network uptime for all hosting services. Planned maintenance is excluded. In the event of an outage exceeding our target, affected customers may request a pro-rated credit. Credits are the sole remedy for downtime.
9. Backups
We perform periodic backups of hosting data for disaster recovery purposes. However, you are solely responsible for maintaining your own backups. We do not guarantee backup availability or completeness. Backup restoration may incur a service fee.
10. Intellectual property
You retain ownership of all content you upload or create using our services. By hosting content on our infrastructure you grant us a limited licence to store, display, and transmit that content solely to provide the services.
11. Privacy
Our Privacy Policy, available at cmcloudhosting.com/privacy, explains how we collect and use your data. It is incorporated into these Terms by reference.
12. Limitation of liability
To the maximum extent permitted by law, CM Cloud's total liability for any claim arising out of or related to these Terms or the services shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
13. Termination
You may cancel your account at any time from the portal. We may terminate or suspend your account immediately for breach of these Terms. Upon termination, your data will be retained for 14 days before permanent deletion, unless longer retention is required by law.
14. Governing law
These Terms are governed by the laws of Spain. Any dispute shall be resolved in the courts of Alicante, Spain, unless mandatory local law provides otherwise.
